Tohalino: Declaran no ha lugar en demanda por difamación en contra de Aquiles Chirinos y Arturo Dueñas

El Décimo Tercer Juzgado Penal de Lima, a cargo de la jueza Rita Meza Walde, declaró mediante el expediente Nº 02811-2018-0 no ha lugar para abrir instrucción contra de Aquiles Chirinos Sullayme, presidente de AUPI; Hermilio Álvaro Vilca y el abogado Arturo Dueñas Segura, por el delito contra el honor – difamación, en agravio de Miriam Tohalino Valencia, mandando el archivo definitivo del caso, dejando a salvo el derecho de la querellante en acudir a otras instancias legales.


Se trata del caso, en el que los imputados manifestaron, según se lee en el expediente, diversos calificativos denigrantes en agravio de la querellante, cuando el 16 de marzo de 2018, presentaron una solicitud de medida cautelar ante la Superintendencia Nacional de Bienes Estatales (SBN) en el proceso que se sigue en contra de la familia Tohalino por la reivindicación de los terrenos que actualmente ocupan varios asentamientos humanos en la parte alta de Mollendo y que la familia asevera son de su propiedad.

A esto se suma declaraciones de los imputados en algunos medios periodísticos y redes sociales, en donde se habría incitado al uso de la violencia en contra de la familia Tohalino si pretendía ésta, tomar posesión de dichos terrenos. Este último punto surgió por algunas notificaciones aparentemente de desocupación que fueron entregadas a los moradores.

Tras la evaluación de las pruebas presentadas por la querellante, Miriam Tohalino, la jueza considera que no se advierte una directa afectación contra el honor, sino más una incitación a obtener a su favor inmuebles, que al parecer no resultarían ser necesariamente de los Tohalino, debido a que la querellante afirma en su demanda que los querellados acudieron a la SBN, y los bienes de los Tohalino resultarían ser bienes registrados en la Sunarp de Arequipa, se lee en el documento.

Por ese motivo, la jueza indica que la denuncia no se encuentra dentro de los alcances del tipo penal denunciado, por lo que no habría afectación contra el honor, correspondiendo denegar la querella.
