Defensoría sobre pareja acusada de trata: “En esta situación la justicia está divorciada de la realidad”

El defensor del Pueblo, Walter Gutiérrez, aseguró que la detención de los esposos chilenos Jorge Tovar Pérez y Rosario Madueño Atalaya por un supuesto caso de trata de personas “linda claramente con la arbitrariedad”.

“Claramente se ha tomado una medida que perjudica a todos, empezando por estos recién nacidos, a los padres y al propio Estado. En primer lugar, porque no se configura un tipo de penal de trata, porque el tipo se refiere claramente cuando se vende un niño, cuando el niño es una especie de objeto o cosa para luego ser explotado”, dijo en Ampliación de Noticias.

“Si hubiera una duda, la jueza está en la obligación de conocer que ya existen por lo menos tres jurisprudencias en nuestros tribunales respecto al reconocimiento de la paternidad de aquellos que aportan la carga genética en estos procedimientos”.

La jueza Elizabeth Castillo Colán dictó 12 meses de prisión preventiva para los esposos chilenos, luego que intentaran salir del país con dos bebés concebidos mediante vientre de alquiler. El matrimonio es investigado por la Policía Nacional en Perú por el presunto delito de trata de personas.

“Estamos en una situación en que la justicia está divorciada con la realidad. (…) Aparentemente habría algunas irregularidades y podría haber la figura de falsedad genérica. Pero esa es una situación que de ninguna manera debió afectar a los niños, estableciendo una medida tan drástica como la detención tanto para el padre como la madre”, sostuvo Gutiérrez.

El defensor adelantó que ha solicitado una prueba de ADN para que se corrobore que los extranjeros son efectivamente los padres de los bebés, “y si no cayera esta medida, la Defensoría presentará un hábeas corpus”.
