Bancos ya no podrán embargar cuentas sueldo de clientes por deudas

Corte Suprema emitió sentencia y precisa que las entidades financieras solo podrán hacer embargos si el monto en la cuenta supera el límite legal de 2,075 soles.

Las entidades financieras ya no podrán descontar o embargar dinero de las cuentas sueldo de sus clientes, en caso que estos tengan deudas atrasadas o vencidas por créditos de consumo, vehiculares o hipotecarios.

Así lo dispuso una sentencia de la Corte Suprema notificada al Indecopi, que precisa que no se podrá efectuar el descuento así el propio cliente lo haya autorizado en el contrato que firmó, según informó el Consejo Nacional de Asociaciones de Consumidores y Usuarios del Perú (Conacup).

“La Corte Suprema ha establecido que las remuneraciones, al ser intangibles y al tener ese carácter de inembargables, no son compensables, es decir no pueden ser tocadas así sea por una deuda, inclusive así el cliente haya autorizado expresamente o por escrito al banco a hacerlo”, afirmó Paúl Castro, presidente del Conacup en RPP Noticias.


Sin embargo, la cuenta sueldo solo es inembargable hasta un tope máximo de 2,075 soles, equivalentes a 5 unidades de referencia procesal (URP). Si su cuenta supera ese monto, la entidad financiera puede embargar solo un tercio del excedente en caso de deudas.

Por lo general, este tope no era respetado por los bancos si el cliente había autorizado en su contrato a que se le descuente de su cuenta por deudas impagas.

“Hay un límite legal que es intangible de 2,075 soles, no es que todo el dinero que sea depositado en calidad de sueldo o remuneración sea intangible y si tiene más, el excedente solo puede ser embargado en una tercera parte”, explicó.

Castro afirmó que si su banco o entidad financiera insiste en cobrarle de su cuenta sueldo más allá del límite legal por un crédito vencido, puede presentar un reclamo o denuncia ante el Indecopi.
